Hang Gliding is a dangerous sport, which may result in injury or death. Permission to use the U.S. Department of the Interior, National Park Service Golden Gate National Recreation Area facilities at Fort Funston (GGNRA-FF) does not in any way imply that the facilities are safe for the intended use. Adherence to GGNRA-FF rules and guidelines should not in any way be construed by the pilot to guarantee his safety. The pilot understands the risks and assumes all liability for accidents that may occur, and expressly indemnifies and holds harmless the Released Parties (as hereafter defined).
AGREEMENT AND RELEASE OF LIABILITY (initial here________).
In consideration for being permitted to utilize the facilities and equipment of GGNRA-FF, and to agree in the sport of hang gliding, ground instruction, solo and two place flight instruction, and related activities (hereafter collectively referred to as hang gliding activities). I, __________________, hereby agree as follows:
1. I hereby RELEASE AND DISCHARGE (initial here _____) the U.S Department of the interior, the National Park Service, the Golden Gate National Recreation Area, the United States Hang Gliding Pilots Association, the officers, directors, elected officials, agents, employees, instructors, pilots, assistants, and fellow club members of all the foregoing, and all the owners of all the facilities and the land used for hang gliding activities (hereinafter collectively referred to as the "Released Parties"), from any and all liability, claims, demands or causes of action that I may hereinafter have for injuries and damages arising out of my participation in hang gliding activities, including but not limited to losses CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES (initial here ________).
2. I further agree that I WILL NOT SUE OR MAKE A CLAIM against the Released Parties for damages or other losses sustained as a result of my participation in hang gliding activities (initial here ________), and I also agree to INDEMNIFY AND HOLD THE RELEASED PARTIES HARMLESS from all claims, judgments and costs, including attorney's fees, incurred in connection with any action brought as a result of my participation in hang gliding activities (initial here ________).
3. I understand and acknowledge that hang gliding activities have inherent dangers that no amount of care, caution, instruction, or expertise can eliminate and I EXPRESSLY AND VOLUNTARILY ASSUME ALL RISK OF DEATH OR PERSONAL INJURY SUSTAINED WHILE PARTICIPATING IN HANG GLIDING ACTIVITIES, WHETHER OR NOT CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES (initial here _________).
4. I have been advised and recognize that my hang gliding activities are not covered by any personal accident or general liability insurance policies issued to the Released Parties (initial here _________).
5. I hereby expressly recognize that this Agreement & Release of Liability is a contract pursuant to which I have released any and all claims against the Released Parties resulting from my participation in hang gliding activities including any claims caused by the negligence of the Released Parties (initial here __________).
